If the conditions for using the vehicle are breached, the Law of Ukraine allows a recovery claim against the person responsible for the insured event. This can be a substantial sum.
Note that the state may widen the list of eligible categories, provided it compensates insurers for the 50% discount out of the state budget.
European Accident Statement (Europrotocol). This is the way to record an accident involving exactly two vehicles without calling the police, and it is then used to settle the claim. It can be completed on a printed form or electronically, the link to the electronic version is normally in the policy itself, one tap from the PDF on your phone. It records the location, time, address, the paths the vehicles took and the other standard details; the prompts make it straightforward. Under Article 32(10) of the Law on MTPL, the Europrotocol is one of the documents the insurer accepts to make a payment.
A Europrotocol is a way of recording a road accident involving exactly two parties without calling the police. It is used for the subsequent insurance settlement and MTPL payout.
Settling the accident without police at the scene saves significant time and means no fine for the at-fault driver.
The Europrotocol, the accident report, can be completed on paper, using the special printed form, or electronically, whichever the client prefers. The link to complete it electronically is usually included in the MTPL policy itself, so it is easy to open the relevant page in one tap from the PDF of the policy on your phone.
The conditions under which a Europrotocol can be completed:
You must notify your insurer of the incident from the scene of the accident, and of your intention to complete the report without calling the police.
The report records the location, time, address, the path the vehicles took and other standard details. Completing a Europrotocol is not difficult, the prompts make it straightforward.
Under Article 32(10) of the Law of Ukraine on MTPL, the Europrotocol is one of the documents submitted to the insurer to make a payment.
The person taking out the contract must give accurate information. The Law requires the policyholder to disclose the material circumstances relevant to assessing risk; the insurer sets the form and method of disclosure and publishes on its website the list of information it takes into account. Intermediaries must supply the same data. Ukraine now has free pricing on MTPL: each insurer sets its own premium using its own methodology, subject to the statutory 50% discount for eligible categories.
Factors that may be taken into account: the claims history of the policyholder or owner; their age; the gross and unladen weight of the vehicle; the mileage at inception and the expected mileage over the policy year, which tells the insurer how intensively the car is used; whether the policyholder is the owner; the minimum age of the permitted drivers; and their licence seniority. Which of these a given insurer actually uses depends on its pricing policy. Commercial use is priced on an entirely different basis.
The following always affect the price: the place of registration of the owner as shown on the vehicle registration document, not where the policyholder lives and not where the car was first registered; the term of cover; engine capacity for cars, motorcycles, mopeds and scooters; number of passenger seats for buses; carrying capacity for lorries; and whether the policyholder is an individual or a company. Because the inputs differ between companies, a proper comprehensive motor insurance comparison is the only way to know which one is cheapest for your specific car.
The MTPL policy remains valid when the vehicle changes hands, right up until it expires.
This is set out in Article 16 of the Law of Ukraine “On Compulsory Civil Liability Insurance of Owners of Land Vehicles”.
In particular, it is the new owner who decides on any early termination of the policy, not the person who sold the vehicle.
The new owner must notify the insurer named in the live MTPL contract that ownership has passed to them. This is done in writing within 15 calendar days, either to the contact email address shown on the insurer’s website or to its registered address by Ukrposhta. The notification must include the new owner’s personal details.
If the policyholder dies, the rights and obligations under the live policy pass to whoever inherits the vehicle.
Direct settlement is where the injured party’s own insurer pays the claim under their own MTPL policy.
The injured party submits a claim to their own insurer under their MTPL contract. That insurer reviews the circumstances, decides, and pays the claimant. The timescales and procedure for handling the case follow the standard statutory rules.
Direct settlement is the injured party’s right, not an obligation.
In other words, the injured party can choose: their own insurer, or the at-fault driver’s insurer. Once you submit a claim to one, you lose the right to claim from the other, and you confirm in writing to your own insurer that you have not approached the other company.
Direct settlement is subject to limits:
– only two vehicles were involved in the accident, both insured under MTPL;
– or only two vehicles were involved, of which the injured party holds the MTPL policy;
– the injured party suffered only material damage to the vehicle, with no injury or loss of life.
After paying the claim, the injured party’s insurer recovers the amount from the at-fault driver’s insurer by way of recourse.
Every insurer selling MTPL takes part in direct settlement. This is required under Article 19 of the relevant Law of Ukraine.
The state digital services app, Diia, lets you check whether your MTPL policy is valid. The vehicle owner can pull the policy and its key details up in the app. An MTPL policy is added to Diia automatically, without the policyholder doing anything. In some cases, though, vehicle owners do not see their compulsory car insurance in Diia.
When an app user buys an MTPL policy, they will not see it in Diia before the start date of the cover (the term of the contract).
The policy may take some time to appear. This depends on how data is exported from the Unified Centralised Database for compulsory civil liability insurance into the Diia app. That process takes a certain amount of time and depends on Diia’s own internal procedures, which the insurer has no control over.
Why does my MTPL policy not appear in Diia?
It is important to understand that insurers and the National Police of Ukraine treat the presence of the MTPL policy in the MTSBU database, not in Diia, as the primary source for checking that cover is valid. This is public information, and anyone can check free of charge whether a policy exists on the MTSBU website, using some of the following:
– the vehicle’s registration number;
– the body number (the unique VIN code) shown in the registration document;
– the MTPL policy number.
Insurers licensed to sell MTPL policies belong to the Motor Bureau. That is where the policy is registered and given its unique number.

Extended liability cover (DGO) increases the level of cover under an MTPL contract.
It is a separate policy that raises the insured sum. It responds once losses exceed the amount set by the Law on Compulsory Liability Insurance.
The practical value of extended liability cover is that it guarantees the at-fault driver full compensation for the damage from the insurer. Although the MTPL limit in Ukraine is gradually rising towards EU figures, it can still fall short.
You should consider buying extended liability cover if:
1. The damage in an accident may exceed the amount covered by MTPL, in which case you would have to cover the difference yourself.
2. The price of voluntary extended liability cover is small compared with the cost of MTPL. The client gets peace of mind for very little money.
3. The vehicle is driven by an inexperienced driver, or is used intensively.
4. The vehicle is driven by someone other than its owner. In that case, it is the owner who has the greatest interest in full compensation for any losses, in case the at-fault driver refuses to pay for the damage.

The grounds are set out in the Law on compulsory civil liability insurance for owners of land vehicles.
The policyholder reimburses the insurer if they: gave false information when taking out the policy and this reduced the premium (penalty: five times the premium, capped at 50% of the payout); breached a restriction written into the contract, such as “no taxi use” or a discounted-category condition (penalty: ten times the premium, capped at 50% of the payout); or failed to hand over accident documents within seven working days of receiving them where this mattered to the settlement (the insurer’s losses).
The at-fault driver reimburses the insurer or the MTSBU if they: were driving under the influence of alcohol, drugs or medication that slows reactions; drove without a licence or without the right category; left the scene or refused a sobriety test; caused the accident through a technical defect in the vehicle or its equipment; used the insured vehicle in a criminal offence; or used a vehicle insured on a discounted basis without being entitled to the discount.
The MTSBU has a right of recovery against anyone who caused an accident in a vehicle with no live MTPL policy on the date, or against whoever bears civil liability for the damage — the owner, typically.
The driver involved notifies the insurer within three working days.
They preserve the damaged vehicle or property in its post-accident condition until the insurer’s representative inspects it — up to 10 working days from notification. The insurer draws up an inspection report and has the claimant sign it. If the inspection fails to happen through the insurer’s fault, you may go ahead and repair the car, keeping proof of what you spent and, ideally, an independent assessment.
The injured party or their representative submits a written claim: within one year for material damage, within three years for injury or loss of life.
Certified copies to attach to the claim: passport or other identity document of the claimant; tax number certificate; the document establishing the right to receive payment (lease, power of attorney, certificate of inheritance); proof of ownership of the damaged property; documents supporting recovery or towing costs; bank account details (IBAN); the accident documents drawn up by the police or the Europrotocol; any court judgment that has taken legal effect; identification documents of the company if the claimant is a legal entity; and documents evidencing what was actually spent on repairing the vehicle or property, or on treating the injured person, where those costs are being claimed.
If the insurer has not told the claimant within 30 days that documents are missing or incomplete, the claimant is deemed to have done everything required. The insurer then has 60 calendar days from receipt of the claim to decide. That clock pauses if the insurer requests missing documents. Where the circumstances are complex and the insurer needs expert examination, the deadline extends until those results arrive, but never beyond 90 calendar days from receipt of the claim.
Ukraine has free pricing on MTPL, so the market offers a wide spread of prices for what is, in substance, the same product. The terms are universal, because they are written into the Law: zero deductible, statutory payment deadlines, settlement without deduction for wear, and the MTSBU guarantee mechanism behind the payout.
Where insurers genuinely differ is in how they behave when you claim. Judge them on: how quickly and simply you can notify a loss; how transparent the payment procedure is; and their average time to pay. That — not the premium alone — is what separates the best motor insurance from the cheapest motor insurance.
